This Privacy Policy describes how HealthSpan Method LLC (“we,” “us,” or “our”) collects, uses, and protects information submitted through the HSM MD Implementation Cohort application funnel, landing pages, SMS program, and related communications (collectively, the “Services”). By submitting an application, opting into SMS communications, or otherwise using our Services, you agree to the practices described below.

2. Information We Collect

2.1 Information You Provide Directly

When you apply for the HealthSpan Method™ MD Implementation Cohort through our landing page or interact with our funnel, we may collect:

  • Full name and professional credentials (e.g., MD, DO, NP, PA)

  • Email address and mobile phone number

  • Medical specialty, practice name, location, and structure

  • Current experience with advanced therapies, including peptides

  • Practice goals and current level of implementation

  • Application responses and pre-call questionnaire answers

  • Payment information upon enrollment (processed via third-party payment processor)

2.2 Information Collected Automatically

When you visit our Site, certain information is automatically collected, including:

  • IP address, browser type, and device information

  • Pages visited, referral source, and time on site

  • Webinar source tags and campaign tracking identifiers

  • Cookie and pixel data from analytics and advertising platforms

2.3 Funnel and Engagement Tracking Data

We use source tags and tracking parameters (e.g., webinar event/date tags, UTM parameters) to understand how applicants find and move through our funnel. This allows us to measure conversion by webinar event, identify high-intent applicants, and personalize follow-up. Data collected includes:

  • Webinar attendance source and event date

  • Landing page visit, scroll behavior, and CTA interactions

  • Application submission status and timestamp

  • Tags applied during funnel processing (e.g., "IC – Webinar Lead")

2.4 SMS Opt-In Information

If you opt into our SMS program, we collect your mobile phone number and your expressed consent to receive text messages from us. SMS opt-in is collected separately from your application and email consent. This data is used solely to deliver the SMS communications described in Section 4 of this policy.

We do not sell, rent, share, or disclose your SMS opt-in information or mobile phone number to any third party for their own marketing purposes. Your consent to receive SMS messages will never be shared with or transferred to any third-party marketer, advertiser, or data broker.

3. How We Use Your Information

We use the information we collect to:

  • Process and evaluate your application to the HSM MD Implementation Cohort

  • Schedule and prepare for your fit/enrollment call with our team

  • Send appointment confirmations, application status updates, and follow-up communications

  • Deliver SMS messages you have expressly opted into (see Section 4)

  • Tag and segment leads by source (e.g., “IC – Webinar Lead”) for appropriate follow-up

  • Route non-ready applicants to the HSM MD Physician Community nurture pathway

  • Improve our funnel, landing pages, and physician outreach

  • Comply with applicable laws and professional standards

4. SMS Communications Program

Program Description

By providing your mobile phone number and checking the SMS opt-in box on our application or landing page, you expressly consent to receive recurring automated and manually sent text messages from HealthSpan Method LLC at the mobile number provided. This is a physician-facing program; by opting in, you confirm you are a licensed healthcare professional receiving messages relevant to your professional development and practice.

Types of SMS messages you may receive include:

  • Application status alerts — notifications confirming receipt of your application and next steps

  • Appointment and call reminders — reminders for your scheduled fit call or enrollment conversation

  • Program announcements — cohort open dates, enrollment deadlines, and seat availability notifications

  • Educational content notifications — alerts when new implementation modules, case studies, or clinical resources are available

  • Community updates — notifications about live sessions, office hours, peer discussions, and HSM MD Physician Community activity

  • Promotional messages — special offers, early-access opportunities, or pricing for current or future cohorts

  • Re-engagement messages — follow-up outreach for physicians who have expressed prior interest but have not yet enrolled

Opt-Out Instructions

To stop receiving SMS messages from us at any time, reply STOP to any text message you receive from us. You will receive one final confirmation message and will be removed from all SMS communications immediately. You may also opt out by contacting us at [email protected] or (385) 786-0415.

After opting out, you may continue to receive non-SMS communications (email, phone) unless you separately unsubscribe from those channels.

Message and Data Rates

Message and data rates may apply. Check with your carrier for details regarding your plan’s SMS and data charges. We are not responsible for any charges incurred through your wireless carrier.

Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission by your wireless carrier and is not guaranteed. Network conditions, carrier policies, and technical factors may affect delivery timing and reliability.

SMS Data — No Third-Party Sharing

Your mobile number and SMS opt-in consent are collected and used exclusively for the purposes described above. We do not share, sell, rent, license, or otherwise disclose your SMS opt-in data or mobile phone number to any third party for their marketing or commercial purposes. This prohibition applies regardless of any other data sharing described elsewhere in this policy.

Our SMS platform provider processes your number solely on our behalf and under contractual obligations prohibiting independent use of your data.

5. Funnel Automation and Tagging

Our application funnel uses marketing automation to manage applicant journeys. Upon submitting an application, you will automatically receive a confirmation email and be tagged in our CRM as an "IC – Webinar Lead." Our team receives a real-time notification and will follow up personally with high-intent applicants.

If you are not accepted into the Implementation Cohort or indicate you are not yet ready, you may be transitioned to a Community nurture sequence and invited to explore the HealthSpan Method™ MD Physician Community. You will always have the ability to opt out of any automated email sequence.

Separate source tags are used for each webinar event and date to enable accurate conversion tracking. These tags do not share your data with the peptide company or event host without your consent.

6. Legal Basis for Processing — U.S. Privacy Law Compliance

HealthSpan Method LLC serves licensed physicians and healthcare professionals across the United States. We comply with all applicable federal and state privacy laws. Our primary compliance frameworks include:

6.1 Federal Law — TCPA and FTC Act

SMS communications are governed by the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and FCC regulations thereunder. We collect express written consent before sending any marketing or promotional SMS messages, consistent with TCPA requirements. Transactional and informational messages (e.g., application confirmations, appointment reminders) are sent under the transactional exemption where applicable. We maintain records of opt-in consent as required by law.

For general commercial data practices, we comply with FTC guidelines on fair, transparent, and non-deceptive data handling.

6.2 Texas — Texas Data Privacy and Security Act (TDPSA)

As a Texas-based entity, we comply with the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541, effective July 1, 2024). Texas residents have the right to: access and correct their personal data; request deletion; obtain a portable copy; and opt out of data processing for targeted advertising or data sales. Requests may be submitted to [email protected]. We respond within 45 days (extendable by 45 days where justified).

6.3 Florida — Florida Digital Bill of Rights (FDBR)

Our physician-founder is licensed in Florida and our Services may be accessed by Florida-based physicians. We voluntarily extend FDBR protections (Fla. Stat. § 501.701 et seq., effective July 1, 2024) to Florida residents, including rights to access, correct, delete, and port data, and to appeal denied privacy requests.

6.4 Utah — Utah Consumer Privacy Act (UCPA)

For Utah-based physicians and users, we honor rights under the Utah Consumer Privacy Act (Utah Code Ann. § 13-61-101 et seq., effective December 31, 2023), including rights to access, delete, obtain a portable copy of data, and opt out of data sales.

6.5 All Other U.S. States

For physicians and users in other states, we apply a consistent privacy-protective baseline: no sale of personal data, no use of information for unauthorized advertising, and prompt compliance with opt-out requests. We monitor and update our practices as new state privacy laws take effect.

6.6 Summary of Legal Bases for Processing

  • Consent — You have voluntarily applied and, where applicable, opted into SMS communications.

  • Contractual Necessity — Processing is required to manage your application and deliver enrollment services.

  • Legitimate Interest — We have a legitimate interest in evaluating physician fit and improving our program.

  • Legal Obligation — Recordkeeping, TCPA compliance, and regulatory requirements may require retention of certain data.

7. Payment Processing

The HealthSpan Method™ MD Implementation Cohort is priced at $2,500. Payment is collected after acceptance and completion of a fit/sales call. Payments are processed through a secure, PCI DSS-compliant third-party payment processor. We do not store full credit card numbers or banking credentials on our servers. Transaction records (billing name, amount, date) are retained for financial recordkeeping purposes.

8. Sharing of Information

We do not sell your personal or professional information. We may share your information with:

  • Our internal team (including Allie and our physician support staff) for application review and fit call scheduling

  • CRM and marketing automation platforms used to manage your application and communications (e.g., tagging as “IC – Webinar Lead”)

  • SMS platform providers, solely for delivery of messages you have opted into

  • Payment processors, upon enrollment, for secure transaction handling

  • Analytics platforms for non-personal website performance data

  • Legal or regulatory authorities when required by law

All third-party service providers are contractually required to protect your information and use it only for the purposes we specify. SMS opt-in data is never shared with third parties for their own marketing purposes.

9. Cookies and Tracking Technologies

Our landing pages and funnel use cookies, pixels (including Google Analytics and Meta Pixel), and webinar source tags to track visitor behavior and measure campaign performance by event and date. You may manage cookie preferences through your browser settings. Disabling cookies may affect page functionality.

10. Data Retention

Application and enrollment data is retained for as long as necessary to manage your program participation, or as required by applicable law, typically a minimum of 5 years for business records. SMS opt-in and opt-out records are retained for a minimum of 4 years in accordance with TCPA best practices. Non-converting applicant data is retained for up to 24 months for cohort nurture communications, after which it is deleted or anonymized.

11. Data Security

We implement administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, or misuse. Despite these measures, no online system is completely secure. We encourage you to use strong passwords and to contact us immediately if you suspect unauthorized access to your information.

12. Your Privacy Rights

Depending on your state of residence, you may have the right to access, correct, delete, or port your personal data, and to opt out of marketing or SMS communications. 13. Physician Community Membership

The HealthSpan Method™ MD Implementation Cohort includes six months of HealthSpan Method™ MD MD Physician Community membership. The Community is hosted on a third-party platform (currently Mighty Networks or equivalent). By joining the Community, you agree to that platform's terms and privacy policy in addition to ours. Data shared within the Community (posts, comments, case discussions) is visible to other physician members and is governed by the Community's member guidelines.

14. Children’s Privacy

Our Services are directed exclusively at licensed physicians and healthcare professionals. We do not knowingly collect information from individuals under the age of 18.

15. Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in our practices, SMS program, or applicable law. Updates will be posted on our website with a revised effective date. Continued use of our Services after any update constitutes your acceptance of the revised policy.
